Nailterest Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Nailterest mobile application (the “App”), operated by Edgist (“Edgist,” “we,” “our,” or “us”).

Nailterest is a social platform designed to allow users to create, share, and discover nail-related content, interact with other users, communicate through messaging features, and explore nail salons.

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

2. Eligibility

You must be at least 13 years of age, or the minimum age required by the laws of your jurisdiction, to use the App. By using the App, you represent and warrant that you meet this requirement.

3. Your Account

To use certain features of Nailterest, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if we believe that you have violated these Terms or engaged in unauthorized or unlawful activity.

4. User Content

Ownership

You retain ownership of any content that you submit, post, or display on or through the App (“User Content”), including photos, designs, comments, and other materials.

License to Edgist

By posting or sharing User Content on Nailterest, you grant Edgist a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, adapt, publish, display, distribute, and promote such content in connection with operating, improving, and promoting the App and related services.

This license includes the right to make your content available to other users and to use it for features such as recommendations, discovery, and promotional materials.

5. Use of Content for AI and Service Improvement

To improve Nailterest and develop new features, we may use User Content, including publicly shared images and related metadata, to analyze, enhance, and train machine learning and artificial intelligence systems.

Where required by applicable law, we will obtain your consent or provide an option to opt out of such use.

We do not use private messages for AI training without your explicit consent.

6. User Responsibilities

You are solely responsible for your User Content and for your interactions with other users.

You agree that your use of the App will comply with these Terms and all applicable laws and regulations.

7. Prohibited Conduct

You agree not to engage in any of the following activities:

• Posting content that is unrelated to the purpose of the App, including non-nail-related content
• Sharing spam, unsolicited promotions, or deceptive content
• Offering or promoting illegal goods or services
• Harassing, threatening, or abusing other users
• Posting content that is obscene, offensive, or otherwise inappropriate
• Infringing the intellectual property or other rights of any person or entity
• Impersonating another person or misrepresenting your identity
• Attempting to gain unauthorized access to the App or its systems
• Using automated means, including bots or scrapers, to access or collect data from the App

8. Monitoring and Enforcement

We reserve the right, but are not obligated, to monitor, review, remove, block, or delete any content or account at our sole discretion, with or without notice, for any reason, including violations of these Terms.

We may also investigate suspected violations and take appropriate legal action.

9. Messaging and User Interactions

Nailterest includes features that allow users to communicate with one another.

You are solely responsible for the content of your communications. While we may monitor or review interactions to maintain safety and enforce these Terms, we do not guarantee the accuracy, integrity, or appropriateness of user communications.

We are not responsible for the conduct of users or for any interactions between users.

10. Salon Listings

The App may include listings of nail salons and related businesses. These listings may be provided by users or third parties.

We do not guarantee the accuracy, completeness, or reliability of any salon information and are not responsible for any services provided by listed businesses.

11. Intellectual Property

All content, features, and functionality of the App, excluding User Content, are the exclusive property of Edgist and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

12. Subscriptions and Paid Features

Nailterest may offer subscription-based features, including Verified and Pro accounts.

Subscriptions automatically renew unless canceled before the end of the current billing period. Payments are processed through your app store account, and you may manage or cancel subscriptions through your device settings.

We may modify or discontinue subscription features at any time.

13. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe that you have violated these Terms or engaged in conduct that may harm the App, its users, or third parties.

14. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Edgist disclaims all warranties, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, secure, or error-free, or that any content will be accurate or reliable.

15. Limitation of Liability

To the fullest extent permitted by law, Edgist shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the App.

This limitation applies regardless of the legal theory on which the claim is based.

16. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect and use your information. Privacy Policy.

17. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the Effective Date. Your continued use of the App after the changes become effective constitutes your acceptance of the updated Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law principles.
